Andrej Babiš, the self-styled billionaire that won the recent Czech election, has declined to offload his extensive corporate assets, while asserting he will address a ethical dilemma that might prevent him from taking the position of prime minister.

Position on Business Holdings

Babiš, whose political movement came first in the autumn election but lacked a majority in parliament, declared in a social media post that he would not sell his Agrofert conglomerate, which operates in agriculture, food production, and chemicals.

“I have repeatedly said I will not sell Agrofert. I have repeatedly stated I will address the ethical issue in compliance with national and European laws,” Babiš remarked. “This is not like selling a pastry in a bakery.”

Head of State's Demand

The Czech president, Petr Pavel, announced that the elderly political figure must clarify openly how he will remove ethical conflicts stemming from his corporate dealings before assuming the role of prime minister.

The Czech constitution “explicitly requires the president to consider the possible emergence of a conflict of interest and the ways to address it” when appointing government ministers, the presidential administration explained.

The head of state “expects clarity in what specific way Andrej Babiš will meet his constitutional and legal obligations”, the statement added, noting that Pavel was prepared to appoint Babiš as premier “without delay” once the issue was resolved.

Corporate Activities and Regulatory Issues

Babiš's several hundred firms, primarily under the Agrofert umbrella, operate in the nation and other regional states, receiving millions of euros in domestic and European agricultural and other subsidies, as well as government deals.

Under Czech law, government ministers cannot obtaining public aid or contracts. The anti-corruption watchdog Transparency International has indicated that to prevent a conflict of interest, Babiš must either sell, refuse public contracts, or stay out of government.

Past Tenure and Present Plans

Babiš affirmed he would “follow the laws” if appointed as prime minister, but did not want to detail how in beforehand because the matter was “an highly personal and personal matter for me, and journalists will always question me anyway”.

During his first term as premier, from 2017 to 2021, Babiš faced multiple legal battles and an European inquiry over potential ethical issues. He temporarily moved his holdings into trust funds, while keeping certain control over them.

The billionaire populist has concluded a coalition agreement with two rightwing fringe parties, the far-right, pro-Russian SPD, which has advocated a referendum on leaving the EU, and the Motorists for Themselves, which has primarily campaigned against the EU’s Green Deal.

The new government, if confirmed, is expected to bolster the populist movement in the region and might strain backing from Western nations for Ukraine – although Babiš has called Ukraine’s president, Volodymyr Zelenskyy, to confirm of the nation's backing.

Pavel, who as head of state has a role for international relations, also requested that the government agenda add a statement on the official stance on the conflict in Ukraine, with a pledge to fulfilling Nato obligations.

The president has earlier said he would not endorse any ministerial nominees who might question the nation's international alliances, a condition that the ultra-conservative party has said it will satisfy by proposing non-partisan experts.
