US Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention
A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later admitted was an error. After his return to the United States to face human smuggling charges, he was detained in federal custody.
In her decision, the court pointed out that the government does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
